These Terms of Service (“Terms”) govern your access to and use of LABELWORKS’ website, custom merchandise, fashion development, production management and all related services (collectively, the “Service”. By engaging with our services, you accept and agree to abide by these Terms.

1. Company Information
LABELWORKS is a sub-brand of HW Studio, under Holographik Workshop d.o.o. We are based in Zagreb, Croatia, and operate under Croatian law.

 

2. Eligibility and Acceptance of Terms
You must be at least 18 years of age and have the legal authority to enter into these Terms. By accessing our Service, you agree to comply with these Terms and affirm that you meet these requirements.

 

3. Scope of Services
LABELWORKS provides customized fashion solutions and consulting services across Custom Merchandise, Fashion Development, and Production Management. Each project is tailored to client needs; however, LABELWORKS reserves the right to adjust project timelines and budgets due to unforeseen changes.

 

4. Client Responsibilities
Clients are responsible for:

  • Providing accurate information regarding project needs, preferences, and specifications.
  • Ensuring prompt and clear communication to facilitate efficient project completion.
  • Adhering to any agreed timelines for feedback, approvals, and payment.

 

5. Pricing and Payment Terms
LABELWORKS offers project-specific pricing and requires payment in installments (e.g., initial deposit and final payment) as outlined in our invoices. Full payment must be received as per the agreed schedule for work to proceed.

 

6. Product Delivery and Inspection
Upon project completion, LABELWORKS will coordinate product pickup or shipment, if required, per our delivery terms. Clients are encouraged to inspect all products upon receipt and promptly report any issues within seven days.

 

7. Refunds, Cancellations, and Modifications
Due to the customized nature of LABELWORKS projects, refunds are limited:

  • Cancellations may be possible prior to production commencement, but deposits may not be refundable.
  • Project modifications after initiation may incur additional fees.
  • Customisable products cannot be returned.

8. Intellectual Property
All intellectual property, including designs, tech packs, and related content developed by LABELWORKS, remains the property of LABELWORKS and Holographik Workshop d.o.o. unless otherwise agreed in writing.

 

9. Privacy and Data Protection
LABELWORKS respects client privacy and data protection. Information provided to us will only be used for service purposes and in accordance with applicable data protection laws.

 

10. Limitation of Liability
LABELWORKS and HW Studio are not liable for any indirect, incidental, or consequential damages arising from project services, delays, or modifications, except in cases of willful misconduct or gross negligence.

 

11. Sample Storage and Liability
We will store samples for a maximum period of one year under the following conditions:

  • First 6 Months: Storage is free of charge.
  • Next 6 Months: A storage fee will be applied.
  • After 12 Months: We assume no responsibility for the return or condition of samples.

 

12. Indemnification
You agree to indemnify and hold LABELWORKS, its affiliates, and team members harmless from any claims, damages, or losses, including legal fees, arising from:

  • Your use of the Service.
  • Your violation of these Terms.
  • Any infringement or violation of third-party rights due to your content or actions.

 

13. Termination of Service
LABELWORKS reserves the right to terminate or suspend your account and access to the Service at our discretion for any violations of these Terms or actions deemed harmful to LABELWORKS, our team, or our clients.

 

14. Changes to Terms
We may update these Terms periodically to reflect changes in our practices, policies, or legal obligations. Any updates will be posted here, with the “Last Updated” date adjusted accordingly. Continued use of the Service following changes constitutes acceptance of the updated Terms.

 

15. Governing Law
These Terms are governed by the laws of Croatia. Any disputes will be handled in the courts of Zagreb, Croatia.
